State of Connecticut: The father of my two adult children died leaving a will and a living trust( with no monies in it) naming them as the beneficiaries. He had remarried two years ago and upon his death left her as the beneficiary of his life insurance. There is an another insurance policy naming his deceased parents so the funds will go into probate. He had also received a settlement prior to his death which the surviving spouse has put into her bank account.
Question: 1. Are his debts only paid out of the estate or is she liable for any of them from the settlement money ?
2.Is the spouse entitled to any of the monies in the estate if the trust names only the children as the beneficiaries?
3. Are his wishes in the living trust valid even if there is no money left in it. ex. jewelry,IRA, antiques, etc.

You guys need a lawyer in CT to handle this, particularly in light of the policy that will revert to the estate.
