Can someone give me info on joint assets in NJ? If a dedent dies with enormous debt but has only joint assets, or assets that fall to a beneficiary, how does the debt get paid? Is there a statute that addresses this? 1) Mother dies leaves a joint acct with daughter - daughter takes money and does not probate - there are debts amounting to $12,000. Where does the money come from to pay? 2) Wife dies, leaving joint accts but also credit cared debt over $15,000. in her name only. Is husband responsbible to pay those credit cards?
