I live in Florida and am the executor to my fathers will. He is a resident of Michigan. I have heard that I can't be the executor if I am out of state. The will was drawn up in Michigan.

DEAR CRUZIN:

The important factor is: what state did he die in? It is that state's probate laws that will apply to his estate.

If you can't be executor, hire a probate attorney to serve instead.

At this time he is still alive and we are trying to get all of his affairs in order. More than likely he will be in Michigan. So what I am wondering is if I am a Florida resident can I still be the executor of his will if he dies in Michigan.
