Is a Will necessary to designate custody of a minor child, if there is no living parent, and a step parent is the choice for preferred custody?

A Guardian is typically named by a parent in the Will and the courts give that designation great weight and appoint the person named 98% of the time.

If there is no parent, an a step-parentis acting as guardian, and the step-parent dies, the court gets involved more closely in the process. Ask the local court clerk what the practice is in your area.
