My husbands father past away April 1999 and his mother past away September 1999. They had been married 25 years with two children. The mother was served with petition papers less than 14 days after the husband's death by the husband's ex-wife. The ex-wife was claiming that they were never divorced. The mother started the legal actiions with a lawyer but got sick and past away before the hearing. After the death of the mother the petition went to the two surviving children. The papers for the divorce can not be found but the place where the divorce was filed for has been located and we were told that the court house of the divorce burnt and all of the files lost. A court date was set and the judge asked if there was a will of the deceased (husband) and if there was it would have to go to probate. The children put the will in probate where it was contested by the ex-wife. The court set a hearing date. The will satates that all belongings were to be left to the Spouse, Hilda Glass and if she proceeded him in death the estate went to the children Wayne and Crystal Glass, the children from their marriage. The ex-wife claims that since they were not divorced that the will is null and void. What the judge and the ex-wife does not know is the two children have since come across two court documents that have the ex-wife's signature stating that she and the deceased were divorced. These doc. were signed in front of a judge. Also, the deceased was a disabled veteran and received months compensation from the government. The ex-wife tried to get compensation from the V.A. and they denied her stating that they recognized Hilda as the widow. We need some advice on the subject. The lawyer was a friend of the father and is kind of laid back. What else can we do to help support this case? HELP US PLEASE>> The court date is January 11,2001.
