What is the name of your state (only U.S. law)? Rhode Island

Around August of last year my friend was working at a warehouse and got injured because he lifted a heavy jack off the floor and it hit him in the head. The company did not have Workman's Comp at the time but was in the process of getting it and from what I'm told it went in effect the next week. He's wondering if he should sue or try to settle out of court. The reason he is thinking of settling out of court is that he was told by a few people not to pick up the jack but he did anyway and doesn't know if that would affect a suit. He doesn't have the money for a lawyer so we're doing some research first.

Thanks
