back injury


What is the name of your state (only U.S. law)? co
I have a back injury with a total body of 15% they, insurance company, has offered $5000. the dr alone for surgery would be $40,000. I have 2 herniated disks. What is a good offer?

More information is needed. Has surgery been performed/recommended? How old are you? What do you earn in gross wages per week? Is 15% the rating your doctor gave you?

I am 45, an independent dr gave me the rating of 15% and the state is colorado

my claim was accected. I received $862.00/biweekly disability.

Has your claim been accepted? Are there other opinions regarding your impairment rating, or has the insurance company disputed the impairment rating?

If the impairment rating is accepted, it is valued at $33,618. This is 400 weeks of benefits for the whole body x 15% for the rating x your weekly benefit rate of $431 x an age factor of 1.3 since you are 45.

I'm having trouble understanding the offer of $5000. Is this to close out the medical because your impairment rating has already been paid? Or is your claim disputed, and this is to resolve the matter on a disputed basis?

The $5000 is to close out the case. I have refused the offer of $5000 and they would like for me to come up with a counter offer

The insurance carrier is not disputing the rating and have accepted it

I receive a biweekly check for the loss. They are wanting to close the case and they want to pay a final and full settlement

You are under no obligation to settle your claim. If you chose to do so, you need to figure out how much of the impairment has already been paid to know what the balance is.

Do you have an WC Attorney? It should'nt cost you anything just to talk to one. Does your Ortho Dr say you need surgery? Have you seen a IME dr yet? Have you thought about a medical set aside before you settle? Once you settle your case, everything is out of pocket.... I would talk to a WC AA before I do anything.
