What is the name of your state (only U.S. law)? PA

In 2009 the Pennsylvania Worker’s Compensation Appeal Board instructed both parties in my case to file a brief in my case within 30 days of the hearing. I have recently discovered (and after numerous request to my Attorney for copies of the brief since 2009) that to this date my attorney has not file my brief. Do I have a case for ineffective assistance of counsel or malpractice?

There hasn't been a ruling from the Board yet.

While I'm not a lawyer, it certainly sounds like you do as far as I'm concerned. He was instructed to provide something to the compensation board and has not done it within the requested period of time (and much longer) this can potentially be very detrimental to your cause. It would certainly be worth talking to another Atty. about.
