Employer denying workers Comp

What is the name of your state (only U.S. law)? Virginia

I'm posting here out of concern for a family member. My brother recently injured his back at work while setting up a ladder (works in pest control) After work, he lost feeling to both his legs, we called 911, the paramedics took him to the ER and the hospital tried contacting my brothers employer regarding Workers Comp, to which the employer said "He was not giving that information" and hanging up the phone. My brother has no health insurance through his company and now his company refuses to pay Workers Comp. In need of some advice and guidance.

(If this helps my brother works for a small business, just the owner and himself, but I have read that in the state of VA they are still required to provide workers Comp)

Have him contact the VA WC Commission for assistance:

Tell him to make his claim using the claim form provided by the Commission:

http://www.vwc.state.va.us/content/claim-benefits-form

He should fill out what he can before calling and someone there will give him further instructions.

Actually, the employer may not be required to have workers compensation coverage for rvalost's brother. An employer with a single employee is not covered by the law.

The brother should still contact the commission to determine for sure if he has coverage or not but he might need to find another source of money to pay his medical bills and continuing treatment for his injury.
