What is the name of your state (only U.S. law)? wisconsin
husband was injured last year on a job he was receiving workmans comp in may the adjuster stopped his payments because his doctor referred him to a surgeon and said there was nothing more he could do for him , so the adjuster said that meant he was fit for work which he is not so we had to try to get a detailed letter from the doctor to explain he didnt release him to work he released him from his care , now 5 months later we have this letter and it states clearly that he never released him back to work and only released him from his care and that all the original restrictions are still in place. during this time we got a lawyer and had her fax it to them but they have not responded in about a month now ..is there something we can do? and shouldn't they have to resume pay including the back pay we lost?

Once you have an attorney familiar with Wisconsin workman's comp, you've about gone the limit on what you can do. If you are approved for the back benefits, you will probably be back paid in a lump sum. There is a limit to the number of weeks you can remain on worker's comp, regardless of whether you have reached MMI or not. At some point they will have to settle out with your husband and he'll go from there to applying for social security disability.

While it may take some time, I wouldn't worry too much about the eventual outcome; WI is notorious among HR folk for approving EVERYTHING for workers comp.
