injured in company demo, do i qualify for workmans comp? What is the name of your state (only U.S. law)? NY My question is, we had left work for the evening and as we got to the first stop light we were hit in the side by a car that had run a red light. i am totally disabled, and just found out it could be months untill i have recoverd enough to return. i dont want to just apply and tick my employer off if i wont qualify but i really could use it. Would i still be eligable for workmans comp even though i had left work 2 minutes previosly? |

| You weren't at work. Seek compensation from the driver of the other vehicle.

| Workers Compensation only covers injuries that are arose out of and in the course of employment. The only way I can see your claim being covered is if you were on the employer's premises when the accident happened, or if you are considered to be a traveling employee. So for example, if you are working in a different place frequently, and have to travel to those different places, you may qualify. This is very case specific. You may try disability benefits.
