need a little adviceWhat is the name of your state? live in MA, injury occurred in MN. Hi, a few years back, I worked for a lovely company at which my boss took certain actions (workload, schedule demands, not wanting me to take breaks, etc) that helped me to develop some problems with my hands. I was in MN at the time, and out there was diagnosed with carpal tunnel, Thoracic Outlet Syndrome and Tendonitis. The pain got so bad that I quit my job and moved back east to MA. Since moving back, have had carpal tunnel surgery on each hand, paid for by my former employer's insurance company. I kept telling them that although the pain changed a little, the surgery didn't end all my pain. I kept getting put off and pushed back and due to financial limitations, didn't get a lawyer at the time. Now, two years later, am working (although at a much lower level than I used to because I can't handle the work I used to do because my hands are in too much pain), but I'm still in a lot of pain. Went back to see the surgeon, who they chose, who did the original surgeries and he's suggesting more surgery on each hand. I'm also seeing other doctors because the surgeon can't promise that what he wants to do will end all my pain. My question is two fold...I'm realizing that I need a lawyer but I don't know how to best achieve that because I live in MA but the company is in MN (the insurance agent for the company is nationwide). Then I don't know what I can do about the fact that this pain persists years after the fact. If I can't recover the total use of my hands, what can I do? I've read things that indicate that I can't sue, but I have lost, and will lose for the rest of my life, so many things that I shouldn't have to lose. I can't do things I love, I can't perform basic tasks that so many people take for granted. And yes, I've lost income that I could have made had I continued on my previous career track. I had to leave that behind and start over in an area that isn't as demanding on my hands because I couldn't handle the pain or physically do the work (this is all professional work, lots of work on computers). In any case, I'm at the point where I have lost relationships because of my hands, I live with family because of my hands, I change my life each and every day because of the limits of my hands. So is there anything I can do to ensure that I don't keep losing? I'm sorry if this isn't as clear as I'd like it to be, I'm just so frustrated. I've realized that if my hands don't get better, I will not have children because I can't hold anything for very long, nevermind a child. I can't do so many things I used to love and I've lost a career I was very good at, so I just don't know. Thank You. |

| You can get an attorney and if the SOL hasn't run you may sue your former employer's work comp insurance carrier. You may have to accept the fact that surgery may not end all the pain you feel. That is just the way it is sometimes with carpal tunnel. I am not sure what you mean when you ask is there any way you can stop losing -stop losing what? I do not believe you will be able to recover for pain and suffering if that is what you are talking about. Surely Weenor will be along at some point and perhaps he will take a stab at your question. As to your losing relationships, may not have children and the like - I am not one to try and make light of anyone's suffering but I have seen people with no arms or legs have relationships and families. You may need to get some sort of counseling to help you deal with this. |
