Question

Out of work on disability and fired!!


What is the name of your state (only U.S. law)? PA
I have been out of work for over 6 months now due to personal illness that I only had while I was at work. I got sick and sick and more sick with documented illness (the same one) from mold in my office. I was out for weeks went back and shortly got sick again. Out again for weeks, went back and got sick again within days. Now I have been off since May. I am pretty sure that they will fire me since I have been out so long and they will not transfer me as others have complained of the same just not as severe. The company will not do anything further, there was testing and half baked cleaning a while ago. Although the last tests results still show mold, they are saying it is safe and no one should be getting sick from it.!! What is my recourse as I was denied workers comp in the begining and have been out on disability all this time if they fire me? My doctor believes something in that office is making me sick and does not want me to return. What do I do if they fire me? Do I have any type of negligence or WC liability case since my immediate boss knew about mold and other things in the office for years before I even got there??? Can I apply for unemployment if I get fired??? Will I ever get back any of this money for all this time??? Will my life ever be normal again? I am so sensitive to odors and things that give me headaches and head pain now. I am barely functional from the medications I am on that messes up my stomach so bad. I have taken so many antibiotics I cant take more or I will get Staff infection or worse. What do I do?

Your recourse, if you are fired, is to file for unemployment and look for another job. They have already granted twice the maximum leave they are required to under the law.

If no one else in the buillding is getting sick from this alleged mold, chances are pretty good that your employers are in the clear as far as any liability is concerned.

The whole story is posted in an earlier thread. There are others that have had both sinus infections just not 11 times in a year. One person had 4 along with upper respiratory infections, one relieved me and was sick 2X with sinus infections and two others in the office are chronically complaining of sore throats, dizzyness, headaches. All the complaints have been sent up the chain of command but they have ignored it all saying that the last test showed safe levels of mold and that no one should be getting sick from it. They refused to transfer me to another office and sent me a letter that I must return to work by a certain date or I will be released from my job. At the very least this should be a workers comp case much less negligence for my boss knowing about the mold previously to my even being hired. He knew that the carpet had been wet many times before but never told anyone he remedied it himself with vinegar and airing it out. When I was there the carpet under my desk was wet for at least 6 months and stunk of mold so bad and no one did anything until my doctor wrote a note due to my being sick so much that year. Is no one responsible for the health and safety of workers? Yes I can go on unemployment and get another job but at this point I am so sick from stress, headaches and diareah all the time I have lost 30 lbs in the last 3 months and clench my teeth at night. What about all the weeks of time I lost due to illness from mold and what about my quality of life during those almost 2 years much less my future?

no problem they should indemnify you for your loss incurred
