please help


What is the name of your state (only U.S. law)? california

i am a hospital wroker, nursing assistant, long story short, i was falsly accused of "misapporiate interactions" with a child patient. what that consist of, is still a mystery today and it happened 5 months ago. first i was placed on investigative leave of absence by h/r, then on that same day i was questioned by police (sex crimes unit) i was asked if i ever said gaa gaa goo goo to a 10 year old patient. asked if i ever sang songs to this patient. asked if i ever told patient that every thing will be alright. never stated anything about fondling, groping or touching wrongly, i was only asked what are my duties for a total care patient. meaning i have to change diapers and clean patient. the police unit was sex crimes unit. investigation with hospital and child services cleared me in a matter of days, got letter head from hospital stating they and child services cleared me. never spoke to child services rep nor did i see a child services rep at the meeting. dont even know what child service wheather county, city or hosp child services that was involved. strangely enough the police dept didnt have letter head stating my clearance because an investigation was still being done with the case, so someone else is involved. i was told i will be contacted, but i have yet been contacted by police dept. the police told this childs father that i was cleared of the allegations. meaning i was questioned and interrogated but i am clear. instantly i have a bulls eye on my back by this child family. anomious people calling my place of employment asking when was i returning to work, childs father being seen in hospital after child was supposibly released by hospital. (i was told child was discharged and gone home by h/r) hospital security is unarmed. i was asked if security could walk me to and from the train station. i rode train to work everyday. did i mention that security is unarmed. this is the same hospital where an employee shot and killed his supervisor and assistant sup and himself. i resigned because of my safety issues. workers comp claim is not revealing the source of who filed allegations or the date reported. i know i have a civil suit. i have gone to three lawyers and all said , too much of hassle to file tort, defamation or civil. there was a lot of unjust actions in the whole circus of actions. how can i find out who said these hurtful things, what date i alleged to have done these things and how can i defend myself and my reputation? what can i do? i had deposition for workers comp this past week. what happens after deposition? my lawyer wasnt present, instead a para legal sat in the deposition. never talked to lawyer. this happened in beginning of march. my legal firm is ? i dont know about these things so i wont judge the lawyer or firm. i am left jobless, homeless, had to quit rn program, i have seen 4 psychologist, and receiving state disability. cant live on the amount of payments. i am going thru hell. so can i file defamation per se. i learned that from this site today. how, in san diego, california.

i forgot, hospital gave me date to return to work, i told h/r my concern of safety they said ok. when asked who made allegations ( asked h/r and police) they both said cant disclose information for safety of that person. the child cant communicate for child had neuro damage. only answers closed end questions with thumbs up for yes and thumbs down for no. i assume he was cohersed. union rep wasnt notified. the date of incident according to workers comp or date of injury was a day that i didnt work. rumors of me being a child molestor, and being escorted by police are floating around as well as many other rumors. character is ruined. how long does workers comp claims take? its been 5 months and i just had deposition. what can i expect since deposition is done?

A suit against who exactly, and for what?

(as a side note - if you've had three attorneys tell you they won't take the case that's usually a good indication that the case will not be successful)

It seems to me that you need to decide to move on from this ordeal. You were cleared of the charges, so there is nothing on your record. There is nothing that should prevent you from finding similar employment at a different facility.

While it is unfortunate that you had to go through this, it seems to me that justice has already been served, as you were not charged with any crime. What happens next is up to YOU. You can decide to dwell on this and essentially continue to disable yourself by fixating on this issue, or you can recognize that your name has been cleared and it is time to move on.

My advice is to put this behind you, and go get another job.
