What is the name of your state? What is the name of your state? currently NY, soon GA.

I was injured on the job when my employer jury rigged a rotten picnic table, unanchored, unsupported, in the back of a pick up truck to spread fertilizer. When the driver swerved to accomodate a pedestrian, I was thrown from the back of the moving truck. My injuries are not servere, and worker's comp. papers were filed when I received medical attention. But, this accident never should have happened. I feel it was a result of gross negligence and reckless driving. Do I have any recourse? And if so do I need to initiate the process before I leave the state?
