Reimbursement for expenses


What is the name of your state (only U.S. law)? NY
My husband was injured on the job in Feb. 2007 At a hearing in Feb. 2008 the comp lawyers were ordered to review his out of pocket expeneses and either pay or send an explaintion of the denials. They were given 30 days. At another hearing in june 2008 they were again given 30 days to do this and again they did nothing. On Sept 4, 2008 The judge ordered them to "front" him $200.00 and they were given 60 days to pay or deny. As of today, 11/06/08, we have not recieved anything. His attorney says to wait until next hearing. No hearing is scheduled at this point. My question is: Is there a law or statuate in Ny that a.) will force them to immediatly pay full amount owed. b.) impose fines or some sort of monetery fee or interest for him having to wait so long. I'm dumbfounded that the NYS Comp board and state insurance fund can ignore a court order 3 times and not be punished or penelized in someway. As a note, we are not talking a few hundred dollars, we are just shy of $3000.00 Thank you in advance for any help or insight into this.

It's a complicated question to answer. Certainly the insurance carrier should comply with the order of the Court - however, just because expenses were accrued, that doesn't mean that they are compensable. What expenses were paid that added up to $3000?

Was the care disputed? Or travel time? I want to help, but don't have enough information.

Thank you. I do relieze that not everything is reimbursable. We submitted for travel expenses, perscriptions, etc...anything we had to pay that is related. The reason these expenses is so high is that nothing has been reimbursed since his accident in Feb 2007. WC has been ordered 3 times to review and pay or deny. I guess the basic question is, is there a law or statuate that i can point to and say....okay they have ignored a court order 3 times so now they have to.....????? I know that in ny if WC does not pay the claiment weekly pay within 29 days, they fined for everyday they are late. Can this same rule apply? What would happen to me if I ignored a court order 3 times? Would the same laws apply to the WC ? I want to be able to walk into court and say...ok your honor, they have ignored your orders 3 times and these laws now apply. Thank you for responding. I look foward to your help.
