What is the name of your state? Hawaii

My husband hurt his back at work. He has since had 3 back surgeries, the last fusing his lower back. The injury occured in 1997. WC made the decision to settle at 54,K. Our whole life has since changed. Can not do alot of the things we all enjoyed doing as a family. Do you think that the amount is worth everything he has endured and will continue to endure? Need to decide soon, have 20 days to appeal. :confused:

Injured workers in CA. are entitled to $ 16K if qualify for Voc Rehab (for injuries on or before 2004 ) Request a copy of your husband's final med report from his Primary Treating Doctor -for his job related injury, in it you'll see the work restrictions and other important info on how the percentage of disability was arrived to, the Ins Co must give you a copy of your disability rated, if you don't agree (your husband) with the PTD med report, he can request to be seen by a QME (qualified med evaluator), check with the Information and Assistance Officer at your W.C. office in your state (check in the phone book), also, WC can not decide on its own on how much $ to give your husband for his injuries, it has to get to an agreement (amount of $) with your husband. Ins. Co will always do their best to give one less than one deserves. Get an attorney! If your husband is still in pain and believes will need future med treatment, file for an appeal and bring this before the judge. Your husband has to speak up and stand up for himself, don't let the Ins. Co. screw him up, get an attorney ASAP
