What is the name of your state?Fla. Injury at work and found out the hard way if you go to the doctors they send you too they say they can't do anything and nothing wrong. If you go to doctors that will help you you get slapped with 100% subrogation for trying to get better. Isn't your lawyer suppose to tell you these things. What recourse does one have to get the subrogation paid by the responcible party. So you can settle or do you have to fight in court to get a fair shake. :(

Yes I know what Subrogation is its the fact that some states have it some don't like Virgina. So your lawyer must fight to make up for this as its not fair that the injured pay for the doctor bills related to his or her injurys. :eek: It would be better to settle then have the doctor treat you so their wouldn't be a Subrogation. Only thing is they probally wouldn't pay anyway because it was accident related.

Either I missed something or there's info missing to this situation.

1. Was your work injury caused by a third party?

2. Is/will there be a civil suit against the third party?

3. Is your health insurance, not work comp carrier the one that sent the subrogation notice?

4. Was this a car/vehicle accident? If so, were you the one cited/responsible for the accident?

5. Do you have an attorney(s)?

6. Virginia's w/c statutes regarding subrogation are irrelevant.
