i was laid off from my job back in december 2001, and received unemployment benefits from dec 2001 to april 2002. in illinois how much unemployment you receive each week is based on your earnings for the last three quarters before you were laid off/fired. my previous employer recorded my earnings wrong. this in turn caused me to be overpaid each week for four months. now the state has caught the error and is claiming that I need to pay this amount back to them. since this was not my fault or error, do i have to pay them back? or is the company liable for the overpayment since they made the error?
