Unpaid from last 4 months

What is the name of your state?NY

I am on H1_B Visa. My employer is not paying me salary from last 4 months. Every time I ask for payment he said he is expecting money as soon as he gets he can pay. Even earlier also he has not paid me regulary at this time total sum he owe to me is around $40,000.

Now I found new employer who filed H1B for me and I am going to join other job. How can I get money from my ex-employer?
