What is the name of your state florida i am waiting for adjuster to call me regarding my claim. just filed 2 weeks ago.have been laid off since then.i have been offered a new job with new employer.the new job is less physical.i asked my adjuster if i could work if it didnt involve lifting etc. and he said yes.havent even seen a dr. yet. i am desperate for income at this point.my claim is for repetitive stress injury as a waitress. the new job is for a management position. should i quit the old job and take this new one? and will it affect my claim?

Why haven't you been to a doctor ?? Were you laid off due to the injury?? I would not listen to the adjuster. The adjuster is not a doctor and can not give you medical advice. Do not tell the adjuster you are trying to get another job. They might think you are trying to file a false claim. You getting another job will definitely affect your claim because you won't have one. A doctor has to verify that your injury is work related. You have to go to a doctor. No doctor - no benefits. Did you fill out an injury report at your job?? There usually is a 7 day waiting period for work comp claims. It doesn't look good that you haven't been to a doctor yet. I live in Texas and have a repetitive stress injury and I reported it to my supervisor and saw a doctor the very next day. From the day I was taken off work I had a 7 day waiting period and on the 14th day I received a work comp check due to me not being able to work. I receive a check every week like clock work. saw the w/c dr today..what a joke

ok..claim filed sept.23..then laid off..employer said i couldnt work without dr release..so i waited for the adjuster to call me back..he called last fri..asked me why i havent been back to work.seems my employer told them i was no show for work.meanwhile i had to take the management job. i couldnt wait.adjuster made an appt with a dr. went this morning.he is a plastic surgeon and hand specialist.bottom line is..he put no restrictions for work..ordered a emg..which by the way could be another month.i told him i was afraid if i returned to work i would do furthur damage, and he said i ought to get a different job.which i didnt yet mention that i already have new job.at this point ..i dont want anything but compensation for time off the last 4 weeks without a job..because my emplyer told me i couldnt come back without dr. release. i dont plan on going back there. they dont have anything that would pay me the same wage..since i was a waitress.making tips.i dont think they even want me back at this point either. so how do i go about getting paid for lost time? and do i need to tell my new job about this claim?and will my new job ins.be affected once im eligible in 90 days?

first off you don't see a plastic surgeon for an injury regarding lifting second your employer has to make your doctors appt. i'm just saying this from past expr. i would say see another doctor preferably the employers work comp doctor and if they tell you that the doc you seen is there doc ask to see one that is not a plastic surgeon

In FL, you must have a w/c doctor send in documentation to the w/c carrier that you CANNOT in order to receive wages for a work injury. Your employer does not make doctor appointments for you as trj5150 stated. The w/c nurse case manager makes the appointments. If you need income, don't quit the new position you took. Have you consulted with a w/c attorney? If not, do so.
