my friend is taking fmla due to a panic disorder. her manager at work appears to have mega mental health issues himself. he is phenomenally smart but erratic. rips his clothes, swears, destroys property, gives directions one week and the next week writes up people for doing exactly as he told them. there are no medical professionals onsite, but many think he resembles a person with uncontrolled bipolar disorder.

there are fears, arguably grounded, that he might retaliate with violence if he is confronted or if a complaint is filed.

at what point, if any, can a person collect wc for a pre-existing mental condition that was substantially worsened by such behavior. by legal definition, can exposing an already mentally fragile worker to extreme mental abuse constitute a hostile workplace.

even his supervisor admits there are reports that he is 'unstable.'

thank you.
