I am inquiring on the whole comp procedure. I have been injured at work 4 times since 2000 and the plant physician stated that it was personal reasons and would not open workman's comp claims. I have a copy of all my records now because I found out that another individual had the same injury from their job that I did, had surgery and then was covered by Workman's comp. Why is it that I get hurt and don't get comp for it but someone else doing the same job and has the same injury I did get it? I am not sure what I should do to persue this if it needs to be persued. Another injury at work happened and when I had to see a specialist they denied comp to the doctor's office.
The plant physician has been known to be a "quack" so to speak...but what do I do? Should I follow this up with a lawyer or is it too late? I keep thinking that I should wait until I am hurt on the job again and have them say that it wasn't job-related and then take all of my records to a lawyer. What do you think I should do. It is really sad that some people can get comp and other's have to suffer.

PLEASE HELP> I don't know where to start. :confused:

I have no idea why your employer has denied any of your prior injuries but the frequency of your WC claims and your obvious prediliction to claim work injuries has given your employer reason to be suspicious and take a hard line. Whether you want to see an attorney is up to you.

As a matter of fact I have not even been injured in the last two years but what I was trying to get at is the next time I get hurt on the job (if it ever happens) are they going to say it was not job related if it was?

You are very bold to say that about them getting suspicious about my injuries. Let's just say I am not a MEdical case and many of the people I work with don't want to work and they do find ways to get WC. I just simply go to the plant physician to report the four injuries in the past and if I was sent to the hospital they would say that it was personal and not job related.

I don't care if I get WC but the face of the matter is if a person has a job related injury or is hurt on the job they seek medical help and then it should be WC due to the fact that it happened on the job right? That is all I am saying and all of my injuries were at work and on my job. They even had to come and get me off the assembly line 3 of the four times and send me to the hospital.

So now what? You still think I am a medical problem and I am just out to get WC? I don't think so...but thanks for the uplifting note. I am just trying to get help and answers. I guess I will go elsewhere. :(

Sounds funny to me. I work on a W/C board at a hospital and after the 2nd time you were hurt doing the same thing you would have been given an assesment to make your job safer.

Also per the W/C laws all injuries need to be reported w/i 24 hrs of the injury. If the work injury is legit then employers take the necessary steps to insure proper measurs are taken such as payment and medical treatment. I am wondering, does your employer offer medical insurance, if so do you have it?

That's not the law in my state. State law varies on the subject.
