Is it worth the trouble? My lawsuit.What is the name of your state (only U.S. law)? New York I contacted an attorney about my workplace injury, but not sure I want to deal with the legal hassle of a personal injury lawsuit. I'm already involved in a workers compensation case. Facts of the case: Working at a building owned by a major nation utility company, doing an HVAC overhaul. While standing on the sidewalk, a 5lb piece of metal struck me in the head which fell from about 75 feet up. No protection. No safety precautions taken. No cones on sidewalk, no net, so warning tape, no flagman. Nothing but sloppy and careless work from the company that dropped the debris. Documented injuries: Closed head injury Concussion Post Concussion Syndrome with continuing severe headaches Shoulder impingement with possible rotator cuff or labrum tear Herniated Disc at C5-C6 Buldging Protrusion at L5-S1 The lawyer I spoke with talked about Third Party Liability, Negligence, OSHA Violations, and Premises Liability. Should I go through with a case? Do I have a case Is it worth the headache (no pun intended)? Ballpark of what this could be worth (i know, there's no way of accuratly knowing... looking for a guesstimate)?? Thanks CK |
