Hi, I had a bad accident at work 15 years ago in a factory. I slipped and fell on loose plastic beads in a plastic department, getting off of a forklift, landing hard on my left knee, onto a metal wire basket (4x5 foot). My knee was swelled and black and blue (I am talking of half my leg) for 2 weeks, went on workman comp for a couple of weeks, then light duty. I had to use crutches.
The hospital took x-rays and couldn't find anything.
I have several times complained to the doctor at the factory where I worked off and on about my leg, with no results. Bending stretching, twisting, turning on that knee. Most of them were 12 hour days, 6-7 days a week.

About two years ago my leg was getting real bad, and unable to walk more than one block at a time. The pain was unbearable, not only did the knee hurt, but all the muscles in my left leg hurts. I have to rest and get the weight off that knee. I changed jobs so I could sit and work, my regular doctors orders. He also had me get a handicap license, so I could park closer to the building.
I retired last May after 30 years in the same factory, drawing a pension.

Two months ago, I finally told my regular doctor I couldn't stand the pain any longer. He thought it was time to find out exactly what is wrong with my knee. He sat up an appointment to have an MRI done, they called and then set up a appointment with the specialist. I had several x-rays taken. I had to go back and have a cortizone shot under my knee cap. With no results, this was about 5 weeks ago.
The specialist found my problem.....
A deteriorating joint with arthritis, osteoarthritis, my kneecap is also offset. He said if the shot didn't work, my next step is a knee replacement.

My doctor, filed it as WC, but was denied. They refiled as regular insurance claim.

My question? I know its been more than 3 years since the accident. I have no idea if my present problem was from that accident, its up to the specialist what he says that caused it. I vaguely remember him saying he didn't think it was caused from the injury of 15 years ago. If he says it is from twisting that knee too much from working, its wore out (thats what my reg. doc said) that caused this. My reg. doctor told me to tell the specialist how I add to work. If I am retired now, could I get compensated for having the surgery for my problem? Would osteoarthritis, be filed for a claim? Could I get WC now that I am retired and drawing a pension.
Would osteoarthrits be caused from working?
What are my rights and what can I do?

I am so confused....what to do..........Thanks ahead of time for replies.........

iowachick, it is impossible for anyone here to predict whether your former employer's WC carrier will accept liability for your knee problem. All you can do is file a WC claim with the employer and see what happens. You may find it helpful to consult with a WC attorney.
