What is the name of your state (only U.S. law)? Virginia

I was at a party at an apartment owned by someone who is 21. The cops came, and questioned myself and a friend. We are both 19. When the cops showed up, we weren't holding any alcohol. Also, we weren't breathalyzed. The cops only asked us if we drank, and fearing a breathalyzer test we both said yes. We have a hearing on monday, and I was just wondering if it would be possible to plea not guilty because there is no hard evidence. I'm not sure though. Please help!

The officer's testimony of your statement, and your statement, are both evidence. Why lie? If you're adult enough to break a law, you should be adult enough to face the consequences for your actions. If you can't stand the punishment, don't break the law.

If course you weren't breathalyzed. You CONFESSED to having consumed alcohol as a minor. That, along with the police officer's testimony, should be sufficient to prosecute. Whether you confessed or they ran a breathalyzer test on you, either way you would have been discovered.

I agree with the last poster. If you are adult enough to make a choice to break the law by drinking while underaged, then you should be adult enough to accept the consequences of your actions. Now grow up and take your lumps.
