My 19 yr old daughter was in a auto accident in NY state. She was at fault and has car insurance. She is being sued for over $4 million. Her insurance co. assures her that they will handle this for her, but has also advised her that her insurance coverage does not cover a claim for that amount of money and she may personally be responsible for any amount over what the insurance doesn't cover. My question is can the person suing her get any money from her personally as she is a college student working part time and paying her own way thru college and has NO assets but her car, which may be worth $1000.00 How can they get more money from her if she has no money?

She may have to pull an OJ........

File for bankruptcy, and not have any assets untill the person who has a judgement against her DIES!

Just like OJ......neat kewl...

So YOU will have to put your house and any money you might give her down the road in a TRUST..., because if you gave her say $5000 she would have to report that, and it will go to pay off the judgement.

But by filing bankrutcy she may not get any credit cards.so why not do something real fast... and sneaky.......have her get 2 or 3 secured credit cards for $1000 or $2000 or more each you give her the $$$$ and it will be deposited in a bank as security for the credit cards....they wont be able to touch that untill she recieves the money, and then she will always has some credit cards as long as she DOESNT include them in the bankruptcy petition.
