A man made a left hand turn into my car when I was going straight (we both had green lights, he needs to yield). It was a kind of low speed accident so no one was hurt but my car was totaled. The police found him at fault and his insurance company did a private investigation and deemed the accident 100% his fault. He tried to accuse me of speeding but the accident specialist said there were no signs of me speeding. The insurance company had someone appraise my car and gave me fair market value for a 1998 saturn $4924.80. That left over $3000 on my car loan. He faught the ticket and lost (but it was reduced), and he is not disputing fault anymore. I sued him in district court for the amount left on the loan and I won. He (and his lawyer) are appealing it (the insurance company is defending him as they legally have to). I received a statement that I needed to file a complaint in 20days. (I have about 9 days left). I filed a complaint however, I did not have the verification for or cover letter, it was not signed and in all reality the complaint was poorly written (for legal terms). I was told I could file an amended complaint. I now have examples of complaints but I have a few questions: 1) in Pa. a fault or not at fault state? (I think it is in the 50-50) how does that effect me?
2) Since he appealed district court what court am I in now? What is the maximum I can sue for? Can I change the amount I am sueing for since district court?
3) To get the amount left on the loan do I need to show that my car is worth more then what was declared "fair market value" or is this damages?
4) If this is damages is it General, Special or Consequential damages? (I thing it's Consequential).
5) Should I be sueing for loss of use until July 2008 when if I paid my exact payments the loan would be over? How do I figure the amount of loss of use per day or per year? (if this is the better way to go can I change it now)
6) What laws enable me to sue for this?
7) After I hand in the amended complaint how do i serve papers? who do I serve them to (the guy or the lawyer)? What is the next paperwork step.
8) I think it's going to arbitration (would it be better to do a trial)? Do I have a choice?
9) Do I have to hand in evidence (ie, proof of what is left on loan, proof of fault) prior to arbitration? trial? what are the names of the forms?
10) Do you know any lawyer that would help me on this case?
