Child Support from Garnished SSDI

What is the name of your state (only U.S. law)? Minnesota

I was divorced back in 1997. My ex husband willing chose to not pay child support and used every mechanism to avoid paying. He currently is 91,000 in arrears. Fast forward to about a month ago.

I was told that he applied and got SSDI. Not sure how (girlfriend works in high powered lawyers office). Anyway, his SSDI is to be garnished. So unless he gets a job I will at least get some arrears.

How does this work. Does SSDI send it to state child support agency and then they send it to me? Is this a long drawn out process to get it actually get the payments. Would I get it the same date every month? Sorry never had to deal with this before.

If he is getting SSDI inquire about dependent benefits for the children that would apply towards his child support.

Assuming the children were born prior to the divorce and knowing the divorce was 20+ years ago is that really the best idea?

I believe the SSA will do their equivalent of the new hire report and find the order. Check with you state OCSE and make sure the order is up to date.

Thank you I will check with child support. Its been over 20 years and my kids are adults now.

This is a monumental surprise to me. I never expected to get any of the arrears.
