Background:
My son's father does not live in the same state as me and has seen our son a handful of times in the first year of life. Our parenting agreement states that I, the custodial parent, must hold health insurance on our son who has several diagnosis and requires specialist. This was my choice as I knew that my insurance covers the specialists and his father has bounced through four jobs in four months I did not want to deal with lack of coverage. I have a good job with good health insurance given my son's many medical conditions.

I just got a call at 5pm today advising that my insurance is dropping my coverage for both of us because I failed to notify them of another policy my son has. I have no policy for either of us other than the one from my work. I advised them of this and faxed a copy of the parenting agreement to them in order to show that I am the one that must hold insurance. They advised me they will keep his insurance active for ten days and then if the other policy has not been closed he will not be covered.

His father is over $3,000 in back payments for medical support already with insurance. Am I able to find out if he holds a policy with my son on it without asking him? Father does not communicate with me or my son (has not seen in last three years) despite him requesting access to video chat and phone calls. Also can I cancel the policy as I am not the one that has it under my name and I am not making any claims under it. But I worry if he makes a claim against it using the documentation I have to give him in order to have him give medical support (again he is several months behind). I don't know what to do, any answers would be appreciated.

I am very skeptical that they can actually cancel your coverage under those circumstances so I very strongly recommend that you involve your HR/Benefits.

But no, there is no way for you to find out about any other policies without asking the father, or at least his employer, and ABSOLUTELY you cannot cancel someone else's policy.

Employer-sponsored benefits are what I do for a living. Tomorrow, since you don't have a whole lot of time, contact your employer's HR or Benefits office, tell them what is going on, and ask their advice and assistance. Also, please ask them for a copy of YOUR plan's SPD (which they are required to give you on request). They might give you a link to an electronic copy and that's okay. It might take them a few days to get it and that's okay too (legally). But as soon as you have it, come back to this thread and I'll tell you what to look for.
