My husbands divorce was in Kansas (and is the current order), his kids are in Illinois. Modifications to child support have to come through Washington state where my husband lives. What I want to know is if Illinois has jurisdiction to add college expenses to my husband. If they do not have jurisdiction to modify the child support order, how can they add college expenses? The divorce decree was silent on the issue. I cannot find the answer anywhere - anyone familiar with this or with UIFSA???

have they gone ahead and arbitrarily added these expenses with notifying Dad or Washington or having a hearing?

they (Illinois) are trying to add it without a trial - they had a pre-trial hearing where the judge basically said she was not going to change her mind - and I don't know if we were able to actually go forward with the "trial". Our lawyer said we should just settle on it but I don't see how Illinois has any jurisdiction. At this point, if the ex wants to modify the support order she has to come to our state, WA, to make any changes which she hasn't done yet since the judge finally after 2 years made a ruling that they have no jurisdiction in Illinois over my husband. It's a ridiculous mess that's for sure. So I guess they are trying to get it added - and if they do, is it considered part of child support or is it a custody issue or what? It is very difficult to interpret interstate/UIFSA laws.
