In a conspiracy action against one AZ defendant and six out-of-state defendants, the appeals court upheld the superior court's dismissal of the out-of-state defendants but sustained the action against the AZ defendant. Can these dismissed defendants be re-added (in the remanded Superior Court action) if evidence supports it?

Without knowing the basis for the lower court's ruling and the reason it was sustained on appeal, it's not likely that anyone is going to feel comfortable guessing at that one. Have you asked your attorney?
