My wife had to undergo a medical procedure. Most of the bills were covered by our insurance. One of the providers bills were not paid. We contacted the insurance about it and were told that they were filed improperly. We contacted the provider and told them they needed to refile and gave them the insurance companys phone number incase they needed to find out what was wrong. They have never refiled and are now suing us for the full amount of the bill. Do we need to refile the case or are they required to? Also one of the dates they have down for her treatment is a date that she was never there. How can we prove that that is not our bill? And no it is not lab tests that were done. It is suposed to be an actually office visit

You need to speak with yyour insurance company. Depending on the relationship between the doc and the insurance company, the doc may not have been able to charge you for this.

How long ago was the origianl procedure?

Do you have a PPO or HMO or any other managed care insurance coverage?

Is this doctor in the listing of "in network" providers is so?

The way to get this done is to pay the bill and then submit a claim to the insurance company. If this was a specialist, he may not have been contracted with your insurance company. Those are things that you will need to explore...
