attorney malpractice?

MY cousin and I recently closed on a duplex in which he agreed to sell me half of the property. The closing was on August 4, 2001. The attorney cashed the check for the closing on October 15, 2001. Yesterday, January 14, 2002, I find out that the closing had not been done at all and the property was not in my name and no papers had been filed. I received no phone calls or communications from the lawyer to let me know there was any sort of problem. There are tax implications (depreciation, expenses) associated with the fact that I don't actually own the property.

Question 1: Is this malpractice?
Question 2: What sort of damges do I ask for?
