What is the name of your state (only U.S. law)? Florida

When we were together, she gave me very many naked pictures of her. Now, she is demanding that I get rid of them.

Do I have to? Aren't they my property?

Would I be breaking the law if I showed them to other people?

What if I told her I would show her dad if she didn't give me 20 minutes to try to apologize on the phone?

(please don't say "move on," that is probably what I will do, and this is not relationship forum)

I know, but would I be breaking the law if I showed them to other people? She could call the cops, sure, but is it illegal?

Can you quote a statute? For example, if I posted them online, or what if I just showed my neighbor?

I am not going to do that, but I'm just wondering what law would I be breaking?

Well, "Doc", as creepy as your mindset seems to be (I do hope you seek outside assistance with that, btw), the real issues aren't about how creepy or childish you're being.

The photographer of an image generally holds the copyright on that image, so you don't "own" the images per se.

As far as forcing you to delete the images you have, I could see that being a stipulation of a settlement agreement, but of course it would be very difficult to enforce. As a civil matter, if you did agree to delete them and then didn't, you'd be in violation of the agreement, but criminally, you won't break any laws by possessing private photos of a consenting adult who herself shared those photos with you.

On the issue of sharing the photos with others, especially her father, my advice is to grow up before you get sued. Using the photos as leverage could be construed as extortion. Just keep private things to yourself. I hope your next potential girlfriend is aware of your intentions to misuse any private photos she may share with you.

This is a question that you need to talk to a Florida attorney about - not because nobody here can answer you, but because you are exhibiting a level of creepiness that is concerning. My I suggest you talk to a therapist about dealing with the residual feelings from your breakup.

Yes, I just read that extortion does not have to involve money. Even by trying to get her to talk on the phone meets the definition.

However, from what I've seen, it is NOT illegal to post those pictures online.

And as far as stalking, there is no restraining order, so that would have to be done first. Plus, nothing threatening has ever been said.

As I stated in my first response, that may be a copyright violation. That's one of those circumstances where you could be sued for a (possibly) non-criminal act.

And as far as stalking, there is no restraining order, so that would have to be done first. Plus, nothing threatening has ever been said.
You need to take a deep breath and use some sense here.

You do not own the copyright to the pictures, she does. Therefore no, you cannot post them online...and you would be an utter creep to do so anyway. Is that really how you want the rest of the world to view you? As an utter creep?

And no, there does not have to be a restraining order first in order for you to be arrested for stalking.

Why would she want to talk to you anyway? What are you going to say? Take me back or I'll post your nude pictures online for everyone to see? No wonder she broke up with you. She probably got sick of getting coated with slime every time she was around you. Yeech!

The whole "I'll show your Dad" thing is just beyond creepy. In fact I think that's about the creepiest thing I've read on these forums for a long, long time. The fact that the question was asked at all is just... gah, I'm getting goosebumps.
