Hypothetical Here: In New Jersey a distracted driver runs a red light. The other driver had a green light, but was underage with a blood alcohol level over .10 and an open container. While the sober driver ran the red, the drunk driver hit the other car. The accident resulted in severe injuries and a fatality. For the drunk driver, this was his second offense within the last year. What kind of punishment are these kids looking at?

The kid needs a lawyer. Even if only charged for the DUI, the penalties are quite severe for second offense. Jail time plus community service plus a fine plus $3000 in license surcharges plus TWO YEARS of license suspension plus the requirement for an interlock to reinstate are pretty much a given. If he is determined to have actually caused the fatality, he could be charged with Death by Auto. With that you're talking three years in prison and lifetime license revocation.
