So thats my legal advice. And you wouldn't be the subject of FALSE ALLEGATIONS - you would be subject to VALID CRIMINAL ALLEGATIONS.

I've managed to maintain my self control for two years. You do not know the circumstances. My children were toddlers when this started, and the adult male
involved is likely a pedophile. You remind me of him, calling toddlers "scum".
I have never lost control, but fear if I do snap, it will be to the point of no return.
You are not in my shoes, and have know idea what you are talking about.
 
The pizza delivery man who delivers after dark. The Hispanic landscapers who speak english but don't read it. The two little ladies walking by on their morning walk gossiping. The audio surveillance affects all of these people and more.

I am looking for the legal definition of the word "consent" in the statute.
If you don't know, then your advice is simply not useful.

I don't agree with this guy, and completly see what you are all talking about with the statutes. While I think his neighbors are probably out of line, I doubt they just woke up one day and decided to terrorize the neighbors. I'm sure OP was no angel in all of this. That being said, I can sympathize with the constant name calling in front of the children. This, however is not a sympathy site....so I'm asking this. What if OP carried a tape recorder in his pocket and when the neighbor started yelling at him he calmly turned it on and said "I am taping our conversation from this point on, if you don't want me to tape you than stop talking" Would that be implied consent if they started yelling again? After he told them about the tape recorder in his pocket? It might at least get the neighbors to be quiet thinking they are on tape.

Like I said, not agreeing with OP.. just curious for my own personal knowledge.;)

definition of "consent" under the statute?

Thanks, but I don't get close enough to these animals for conversation.
They have been court ordered to have "no contact" with us, but that is a rather
meaningless order in the district court. I do not speak to them at all - ever.
Even when they scream filth.

I think it's a shame that the people in this forum are such bullies that you feel the need to beg them not go get mad at you for making a suggestion.

No Quincy, there has been no libel here. First of all, “likely a pedophile” is clearly opinion, which is not actionable. Second, a defamation victim would have to come forth and prove that someone here was able to link the accusation to HIM.


Donovanatee: These people cannot simply argue the merits of the situation. They are apparently unable to decipher the plain English in the statute, you have somehow injured their egos by questioning their opinions. Now they must all gang attack and convince themselves there is something wrong with YOU. It is a sick game that is the hallmark of this site. This thread has been hijacked so I am going to start a new one that will address the meaning of the statute and only the meaning of the statute. If ANYONE in the new thread deviates from the discussion of the meaning of the statute, I will report the post. Hopefully, with a clean thread, we can engage some of the more knowledgeable members of this particular forum.

That's what they've been doing. What are you waiting for? This thread is doing nothing but chasing its own tail. Are you waiting for everyone to agree on one answer so you can go off on your merry way and put the damn thing up?? Even if everyone were to agree, what difference would it make? If the unanimous agreement is that you're wrong, you're just going to continue to argue. If the unanimous agreement is that you're right, what good does that do you? If you get in trouble for this are you going to tell the cop/judge/lawyer/whatever that everyone at freeadvice.com said it was okay?

Just go do what you want to do. When you're vindicated or sued or paroled or if they let you have a laptop on Death Row or what-the-hell-ever, come back and tell us what happened. Then we'll know what the right answer was.

You're not going to get a definitive consensus.

You can obviously hear them from wherever you are standing, so maybe saying it just as loud as they are yelling at you and holding the tape recorder up so that they can see it would make them think twice about what they are saying to you?:confused:

It's not that they're bullies, :rolleyes: I just wanted an answer to my question without having people tell me how threatening to kill people is wrong and why am I agreeing with you. I honestly think that you should cut your losses and move. I mean...it may cost you a lot of money but life ain't always fair. I know it's tempting not to let the bullies "win" but unfortunately it might be just as costly to fight them in court then it is to move. In the end, you'll have the satisfaction (maybe) of making them move but you'll be out a lot of money. It's almost like road rage....just not worth it. Save your sanity. Just move and give your kids a good environment to grow up in. It doesn't mean they win or you lose.

I've already explained all of this in another post in neighbors & boundaries.
Moving is not an opton. We are, however, getting help from the police.
I am hopeful that the neighbors will be strongly encouraged to cooperate.
We are doing our part to maintain self control. None of this has anything to do
with my question however, but thanks for your post.
