can she change my kids name?

What is the name of your state? TX

My ex and I have been divorced for 2 years. I found out last year she regestered my kid in a day care under her step fathers surname. When I found out I called the daycare and demanded they use my daughters legal name. All was fine until this fall when it was time to begin a private school.

I just found out that she is regestered with his surname again. We have joint custody and I pay childsupport.

They do not know I know about my daughters name.

What should I do to ensure this does not happen again?What is the name of your state?

No, they haven't legally changed your child's name. They cannot do that without your permission, or the permission of the court.

Seems like the X may be subtly trying to edge the dad out and have a step move in this/her place.

This is time to have a heart-to-heart with the X about unacceptable actions. If the behaviour continues, then you need to take it to court.

x was was warned the last time she tried to change my daughters name. x is a B who just wants to pretend that I don't exist.

I suggested this for someone else whose ex was playing games with his child's name. Have your family members and yourself give kiddo gifts of magazine and other type subscriptions of whatever she is interested in so that she keeps getting cool stuff at home to her legal name . :D

Maybe some other personalized stuff, like a sign for her door with her name, a bean bag chair and anything else you can think of.

And, of course, DO file contempt.

File a police report against the school as the school is breaking the law if they have a child REGISTERED under a name other than their legal name. You can file contempt against mom as well as the school by the way. Schools are supposed to get copies of birth certificates and other records to verify the names of the students they are enrolling.

I have NEVER been asked for a copy of kiddos birth certificate by her school.

There is no way she could register the child under a name other than what is on the birth certificate and social security card. She would have to legally get a name change, and provide that documentation for the child to be registered any other way.

Here is what one school requires -

"New Students Please bring the following items with you for registration:

1. birth certificate

2. updated immunization records (See Immunization Requirements)

3. proof of residence

4. student’s social security card or other proof of Social Security Number

5. record card from previous school attended (if applicable) "

With all of the immigration issues we have here in Texas, can you imagine if you could just walk into a school and say, "Here is child's birth certificate, but her name is really __________," or, "This is my kid __________, just believe me." Yikes!!!!

I would also suggest, as other senior members have posted, to file contempt charges. And I love the idea of registering her for magazines in the "correct" name.

His daughter is in private school so the "rules" may be flexible

Wow, I thought all schools required a birth certificate!

I am a teacher in a Catholic school (in La, which I know is no help to the OP....I'm just sayin....) and I have twins whose name was recently changed to dad's. Dad had informed the school but hadn't submitted the new birth certificates when it was time to do report cards and I was clearly told by admin that I could NOT put their "new" name on the cards until we had the certificates in hand.
