I just got a letter from Gibney, Anthony & Flaherty, LLP for selling a fake rolex on ebay in which I bought a couple of weeks prior on ebay as well. Basically I was selling something I bought because I couldn't return it back to the seller.

Gibney, Anthony & Flaherty, LLP, the firm for Rolex sent me a letter requesting the following:

(1) surrender all counterfeit Rolex goods in your possession, custody or control;
(2) provide the identity of the source of the counterfeit Rolex goods; and
(3) make payment to _Rolex Watch U.S.A., Inc._ by bank or certified check, or money
order, for all damages and costs incurred by Rolex in connection with your illegal
conduct, in the amount of $300USD.

I would appreciate someone chiming in further on this issue. What should I be doing? Should I pay the $300 bucks and get it over with?

How long ago did you purchase the watch? Report it to eBay, you might still be able to dispute the charge to your credit card!

The OP's problem was not that he bought a fake Rolex, his problem was he was trying to sell a fake Rolex.

I now got an email......do I need to reply? How serious is this?
They won't sue you for $300. Tell them the watch is destroyed, who you bought it from and that you are a starving student and don't have the money. Block their email address and you will never hear from them again.

I didn't know that I can dispute in such case with ebay. I bought it from ebay....didn't know it was fake either. I just put a bid and forgot it....until I won. I couldn't back off the deal, because ...one, I thought it was a good deal. Even had I found out that it was fake, I couldn't just cancel the bid. The bonehead might put a negative feedback. Yes, I bought it from ebay...and attempted to sales thru ebay right away...but I noted that it is fake. Thus, the listing was taken down soon after.

I'm sorry, I'll slow it down a little so that you can follow along! He said he just purchased a fake watch from a seller on eBay. Then he tried to sell it on eBay and was reported by someone to Rolex for selling a fake. The first thing he should do is report the original sale to eBay and his CC company to try to get the charges reversed. Then he can get his money back! (You still keeping up?) Next he should cooperate with Rolex by turning over any information he ha about the original seller so that they can maybe get the source of the fake watches. Last he should tell them that he can't afford the $300, and since he thought the watch was real doesn't feel he owes them it. The one thing you got right was that they probably won't sue for $300!

This was done from ebay back the end of March. I just read ebay "help", dispute must be done within 45 days. I guess I am in SOL situation now?

How long ago did you purchase the watch? Report it to eBay, you might still be able to dispute the charge to your credit card!

My sate is Florida. I purchased an item online and put it back on the website I got it, only to get the dreaded cease and desist email. What did you end up doing? Have you seeked any professional advice? Are you in jail? (j/k)

I realized His post was very old, but I do not know how to handle the situation if I don't know what ended up happening.

I received a second request, and I have not sold anymore merchandise, so I think i am safe. But I will try to remember to get back on here and let everyone know the outcome of the situation

Rolex

I purchased a watch from an estate auction. I tried to sell this on ebay. I told in the auction that this watch has no papers or box and that I dont know if its real or not so bid accordinly.
Ebay canceled my auction and then I got a letter email from the rolex law fim, which stated the same information that was recently posted about surrender and pay 300.00
What should I do?
