Bad Check Recip

Junior Member
What is the name of your state (only U.S. law)? Texas
We received a check from our customer in the amount of $5,000. We have been checking with their bank for over a month to see when funds may be available. They have never been available.

We cannot get the check issuer to answer our phone calls. What recourse do we have in collecting these monies? Do we need to contact a lawyer or our bank or what exactly should we do?What is the name of your state (only U.S. law)?

In order to claim a loss you will first have to deposit that check. I would recommend that you deposit this check completely on its own separate from your normal banking. Once the check comes back NSF you will have recourse.

You can then begin the process to sue the bad-check writer in small claims court. Contacting your bank won't don any good and contacting an attorney may cost your more money when you can handle this on your own with very little cost.
