Does tenant have to get notice on the 1st of the month?

What is the name of your state (only U.S. law)? Maine

Does a month to month tenant have to give notice on the 1st of the month that he/she is going to be moving out or can then give a 30 day notice mid month if they pay for 1/2 the month they will be there??

And can a lease state that anyone staying 3 or more nights must be considered a tenant on the lease if all costs are built into the rent already (such as heat and electric)???

In general, tenants are required to provide thirty (30) days written notice to vacate. Most states require thirty (30) days written notice to begin with the next monthly rental period. Some states require a literal thirty (30) days written notices to begin with the date notice is given. Other states require less than thirty (30) days notice and other states allow notice to be dictated by lease agreement. Check with the State of Maine’s attorney general, housing court division, and local authorities to confirm state requirements, if not specified in the lease agreement.

A well-written lease agreement will specify all tenant occupants by name, including adults and children. LLs are obligated to confirm and identify the occupants of the premises for safety and security reasons. The lease agreement can specify and limit the number of days that a guest (unauthorized tenant) occupies the premises. A guest that occupies the premises for more than the number of days specified is considered a lease violation. An unauthorized tenant is considered a lease violation regardless of the number of days of occupancy.

A notice to vacate MUST be given ON OR BEFORE the rental due date. If it is given after the rent date, it is counted towards the next month. In your case, the tenant gave a 45-day notice to vacate.
However since it is a month to month lease, some states have different laws which allow for a two week notice or less. You will need to verify.
