What is the name of your state (only U.S. law)?
CA

I bought a scan tool for my business from autoenginuity.com when I received the item I found out that it doesn't cover quite a few systems and certain vehicles. So it's useless to me and I wanted a refund. Called them up requested a refund and they point out that they don't do refunds for software products. But i only bought the hardware portion I didnt pay for any software. I am arguing that it is not as advertised and that the info about returns is misleading. I payed through paypal direct from debit account meaning that I cannot ask a CC to stand by me. I feel that I deserve this refund They are in Arizona IM in California. This is frustrating and I am not happy. Please advice what to do.

Did they advertise that it would cover "all" systems and vehicles? What is their return policy on tools? Is there any sofware included with the tool?

What specifically about the product is misleading and did the merchant ever say they would accept a return? Did the merchant incorrectly state it would work with those specific vehicles that it does in fact not work with?

Seems they are wasting time with me I called just now and he says that I bought a software based product. ON the bottom of the "order online" page they state that software based products are non refundable. OK I told him I didnt receive any software with the purchase therefore I bought only the hardware . I my argument is the 30 days isnt up yet and he says I am stupid for no understanding that since they don't mention anywhere on the site that VOLVO isnt covered that I have to assume that myself.he said they don't have time for me now and he just hangs up . I've asked to speak with the owner and he is always "not here". I am just frustrated at this point

Unless there is something on their website claiming Volvo support, you did assume it worked with Volvo models. You also assumed you could return non-software products even though they didn't state that was allowed.

I can sympathize with you and everybody at some point has probably bought the wrong part but that doesn't mean the merchant has to make an exception to their return policy.

so I asked what then is returnable. he says .....after a long pause, cables he says. I have the cable only and they don't take this one but they do take back the other cables. hmm seems like I am tricked and lied to along the way every time I ask them something.

Head on over to AZ and sue the bad guys in small claims court. You might win. You WON'T get compensated for your travel time.
Next time, use a CC.

Just for the record, the company doesn't HAVE to refund you:

All prices are subject to change without notice.
Wire transfers under 500 USD will require an additional 25 USD for banking fees.
Prices are current as of Jan 16th, 2010.
No sales tax is charged to orders shipped outside Arizona.
Prices do not include shipping charges or duties.
A 10% restocking fee is applied for all returns. Software-based products are non-refundable and are exchange only.
All returns require an RMA #. No RMA # will be given for any purchase after 30 days.
RMAs are given at the discretion of AutoEnginuity.

And, just to be thorough:

Scan Tool

AutoEnginuity's Scan Tool is a hardware and software combination for Windows PC, Windows Pocket PC 2003SE/2005, and Windows Mobile 5/6 compliant PDAs, and Palm computing devices.

You didn't just buy the cable for $250.

(Each above cite of information came from various places on autoenginuity.com.)

The site does say
AutoEnginuity's® Scan Tool is a professional PC, Pocket PC, and Palm diagnostics scan tool for all OBDII (OBD2) and EOBD IV+ compliant vehicles.
So if the device does not work with a Volvo that is OBDII or EOBV IV+ compliant, he has a case for misrepresentation.
