Just want to point out that Maryland does NOT require "fault" for divorce. A 1 year separation is all you need.

You're right - I misread the above link.

They need to be separated for one year if they agree to the divorce and 2 years if they don't agree.

So, either way, they can't get divorced right now (unless stbx can file for a fault divorce in MD.

OP needs to move to VA and start the separation clock. Assuming that stbx agrees to the divorce, then they will both have the same 12 month clock, so either one can file in their state at the end of the 12 month period.
