Just throwing a wild idea out...

Could the name of the community still be owned by the developer and he/she is allowing the HOA to use their copyrighted/trademarked name? Meaning the HOA doesn't actually have a claim at all?

That is certainly a thought.

Not that it would change the advice offered Jetacle much, though. ;)
