I was in an auto accident on July 12th that was deemed the other persons fault by the police report, my insurance (nationwide) and the woman who hit me’s Insurance (Allstate). Nationwide and Allstate are handling paying out the total loss for my car and I have gap insurance for the rest of what I owe. My problem is that I have no down payment for a new vehicle because I just bought the van that was totaled less than 6 months ago. It just doesn’t seem right that this lady can hit me ruin my life and now I have no vehicle to be able to get to work and could lose my job.

Is there anything that can be done to make me whole again, to get me back to where I was before the accident?

You are being made whole. Financially, you are going to be in the exact same position you were in prior the accident.

What US state did this occur in?

Did you settle? In other words, are you still in negotiations or have they ended with a promise or delivery of a check to you for signing a settlement?

If you've settled, you're done. If not, you can always try to negotiate some pain and suffering that can give you the cash flow needed for a down payment.

How is the van involved? Are you saying that you've been involved in two collisions in 6 months where two different vehicles of yours were totaled?

I have not settled I can’t get Allstate to even return my calls

If they won't return a call, send a letter. If they don't reply I'm not sure suing the other driver would be worth it. Since there is no third party bad faith insurance claims in Indiana so the only real stick you can hit them with to make them talk with you is the potential cost to defend their driver. The other end of that stick hits back. Do you have any physical injuries?

Your insurance can cover your damages and then will pursue the other party for payment. Your deductible will be refunded once they collect from the other driver's insurance.

It was just one van and the van is totaled radiator was cracked
I suggest you buy lower priced vehicles with lower payments so part of your earnings go into savings so that you'll have money for a down payment on another car if this happens again some day.
