What is the name of your State? Texas

Hello, I did a payday loan few months back but couldn’t pay it back. Got a call from a company called EAS stating that I committed some sort of financial fraud that unless I payed they were sending my case to the court for a misdemeanor charge I ended up getting scared and verifying all my information with them. Is this true?

Office of Consumer Credit Commissioner has advised the payday loan industry that “criminal charges may be pursued only in very limited situations” where it can be proven that a borrower knew a check would bounce.

The Consumer Service Alliance of Texas, a trade association representing 80 percent of Texas’ payday and title loan companies, is even more strict about the practice. “Members will not threaten, or pursue, criminal action against a customer as a result of the customer’s default on a credit service agreement,” according to the group’s website.

Yes I read that as well about landing in jail. So I called the payday loan company and got the collection agency that took over the debt and it was not the people who were calling me. The people who were calling me had my vin number on my car and multiple other things

No checks were bounced..they attempted to take out an ach payment but I had my bank stop it. The lender sold the debt to a collection agency

Oh, you mean that you authorized a payment and then blocked it? That's pretty much the same thing as bouncing a check.

I guess I should revise my question..if criminal charges can be charged shouldn’t somebody else be calling? These people refused to give me information except that if I don’t pay that my “case” will be turned over to the county. I contacted the courthouse and they didn’t have any information about anything

Xxxxxx that’s the number of the company that called me. If you google search it it will tell you a lot about them

I would assume that turning it over to the "county" means the county prosecutor, not the courthouse. There are several steps between reporting a crime to the county prosecutor, charges being filed, and a case being visible in the court records.
