I was pulled over last week by an unmarked truck. Since I did not know if the truck was official, I never actually pulled over until the first marked AZ State Trooper with the DPS arrived behind the truck.

My friend and I were ordered to exit the car at gunpoint. This was an ordeal as my friend is non verbal and special needs.

The emotionally charged undercover narcotics detective was on his way home when he decided he had a problem with my driving. He and his passenger (partner) had pulled up along side me on the interstate giving me dirty looks before they slowed back down and got behind me.

After following me about a half mile, and I just continuing in the same direction and manner as we all had been for about 30 miles, they decided to light me up.

I kept heading to my destination and the marked DPS officer did not catch up to us until miles down the road.

This had obviously upset the driver of the truck as he was the one pushing my charges. I explained to him I did not know if the car was official so I wasn't going to stop until a marked car showed up.

At this point he told me I would be going to jail and my car impounded. He also took and confiscated my cell phone as it was recording when we were stopped. He said it would be used for evidence in the case. He had another officer call my buddies mother to come pick him up 15 miles back on the interstate and still 40 miles outside the town we live.

I was more than compliant with all officers after the stop. I had told my side of why I did not stop, and when he tried to get me to argue with him I just deferred and was quiet.

The emotionally charged officer had told me while in cuffs in the back of another DPS officers car that he was only going to pull me over and give me a written warning, but since I did not stop he was going to give me the large ticket(s) and take me to jail.

After an hour or so in the back of the car while he decided my charges and wrote my ticket, I was told that I too would be let go with my buddy to be picked up by his mother. He had already impounded my car, and did say he was going to keep the phone that was recording. The tickets he charged me with were 28-622.01 (unlawful flight from law enforcement vehicle) and 28-695A (aggressive driving).

As I was being escorted (no longer cuffed) to the vehicle that was going to be giving me a ride up to meet our ride home, I thanked the original detective that pulled me over for being generous in not taking me to jail. He responded with "I am not being nice, I am just being lazy."

I spoke with a lawyer later the next day after getting my car out of the impound lot ($187.50). He mentioned that the officer charged me with the felony flight which clearly states it must have been fully marked law enforcement vehicle, which in this case was definitely not. Also since this is a fellony charge he would have needed to conduct more than just a paper arrest. He mentioned he could get the flight charge dismissed no problem.

The next day I received a call from the now not so emotionally distraught original detective that made the stop and charges. He stated that he had some time to think about it, and that he was not going to charge me with the flight at all. He said if his daughter was being followed by a random unmarked car with red and blue lights and a siren, he wouldn't want her to pull over either. He also mentioned that he would like to get me my cell phone back, because it would not be used as evidence as the flight charge was being dropped.

The next day I appeared in court to set for pretrial and plead not guilty, but the court still had both charges on file. The judge did mention something about how it would not be the felony charge flight which is clearly printed on my original citation, rather the misdemeanor lesser charge for flight from an officer.

My question is, can they impound my car for aggressive driving charges? I have valid license am 37 years old, and there is no theft or title or registration legalities in question. He obviously realized that he never should have taken my phone, nor would be able to use it as evidence. I am guessing he realized he completely messed up with his charges, if not even stopping me in the first place. It seems he is just scrambling to hold on to whatever he can at this point. I mean he basically called me on my phone and told me I was right not to pull over, and that he over charged, and that shows he to be emotionally aggravated at the time of the stop.

I am thinking he never should have made a traffic stop, as he was, and is not a traffic officer. I am also thinking the aggressive driving should be dropped as it shows much incompetence and decisions made while upset over something he agreed was right days later. I am under the impression that they can not impound my vehicle, nor confiscate my phone for the claimed aggressive driving charge.

I know this is long winded, however it is the best I could describe my most interesting police interaction to date.

I appreciate any advice, and this forum to ask my questions. Peace and Blessings to all. Especially the officer who obviously needs a vacation.

No, it was not the best way to describe the situation. 90% of what you posted seems to be nonsense and of no use. I don't even want to read all of it. After three lines I had enough.

You have an attorney so maybe he will be more willing to hear your rant. You shouldn't be talking to a bunch of strangers on the Internet if you have an attorney. If you don't like or trust your attorney get another one.

28-622.01. Unlawful flight from pursuing law enforcement vehicle; violation; classification; marked and unmarked vehicles

A driver of a motor vehicle who wilfully flees or attempts to elude a pursuing official law enforcement vehicle is guilty of a class 5 felony if the law enforcement vehicle is either:

1. Being operated in the manner described in section 28-624, subsection C and is appropriately marked to show that it is an official law enforcement vehicle.

28-624. Authorized emergency vehicles

C. The exemptions authorized by this section for an authorized emergency vehicle apply only if the driver of the vehicle while in motion sounds an audible signal by bell, siren or exhaust whistle as reasonably necessary and if the vehicle is equipped with at least one lighted lamp displaying a red or red and blue light or lens visible under normal atmospheric conditions from a distance of five hundred feet to the front of the vehicle, except that an authorized emergency vehicle operated as a police vehicle need not be equipped with or display a red or red and blue light or lens visible from in front of the vehicle.

Was the advice from a real attorney of just a friend who has read a book or 2 because you said he "Lit you up" which would indicate that the truck meets the definition of an emergency vehicle?
Narcotics officers don't ordinarily run traffic stops. so he pulled alongside you to see either who you were, or what you were doing. One of these rang a bell with him so he "lit you up" indicating that you should stop, which you didn't.
Oh and if you run from the cops while driving, expect it to involve firearms being pointed at you when you finally condescend to stop.

So; yes, I think it's a valid use due to the posters attitude towards the officer.

In fairness, the original post has been... edited. Before editing, the poster's attitude was even more offensive.

Forgive me ladies, but sometimes the truth is offensive to those who hide behind bages, work desks, or only pick and choose what parts of the Good Book to follow. If you only pay attention to the law books of the land, it will leave you old, cranky, and stuck.

Don't worry so much about me Kneel4Cops I will never kneel to cops, but am proud of you for finding that is the easiest way for you to get a free protein shake for your post shift work out.

It is not illegal to have no respect for the law of the land and the henchmen that fail to enforce it properly. I have found as long as I follow the Word and Laws of the Creator I will always be able to do whatever I wish, wherever I wish, whenever I wish. I call it dickballing and recomend it to everyone. It is much better than working.

To all of the super smart fancy pants lawfolk hating or talking above me cause I never cared to try and stack any more money than my family already has in banks we own, just so I can put away in trust funds for my kids so they can be as lazy and opinionated as me the rest of their lives, like you seem to sell out everyday as a career to attempt to do, give it up, it's just paper and it won't make you happy, like long winded run on sentences. All I juana know is how can I tell the judge in legal terms that I want the aggressive driving dismissed as well because of more incompetent than usual police work?

He initially overcharged me with a felony flight, which in his aggravated mind justified taking my cell phone, impounding my car, and me to jail. Then decided to let me back loose to go my own way, but still left a charge which has to be a fully marked car I "fled" from, and took my phone, and impounded my car. In his own words that day he only let me go cause he was being lazy.

Then the following day called to tell me he was also not proficient in determining traffic charges, as he was dropping the felony flight. This is because the car was not marked, and his too lazy to take me to jail, meant that the felony flight would not hold up. He also needed to get me my phone back as he never should have taken it in the first place and would not be able to use as evidence.

My question is, how do I best ask the Judge and DA to drop the aggressive driving as well?

They never should've impounded my car or taken my cell phone for just aggressive driving in AZ. Especially when I was only paper arrested and left to go. He was obviously overreacting and letting his emotion get in the way of doing his jobby job correctly. Even jumping departments from hard core Narc officer to simple traffic cop.

If you guys can keep from getting too sad from my messages of truth I post on here and do not flag me your reward will be I will keep you posted as to what happens as I continue to get off the hook on this one. In the rare case any of this sticks, I will be glad to tell you all some more truth and then ypu can all celebrate my minor wrist slappage.

there is no need to take this so seriously I mean I'm the one that had my rights violated and frivolously given fraudulent charges. I think it's rather funny and I'm just trying to figure out how to finish proving I am always right. Plus I am preventing different types of slappage and wrist workouts for most of you that actually take time from your busy interweb naughty time workouts. Your children and ex or unhappily married wives thank me. Sinners.
