Good Day

Today I was robbed at gunpoint.In my statement I said that I had 5000 cash that I won from the casino .I did win from the casino but a few days earlier, not the same day as the crime which I reported.I said I had 5000 with me in the car and my phone has been stolen with my wallet and backpack.If the police do not find me cashing out at the casino the same day i was robbed, will i still be held liable for perjury? I do not have any claims for insurance on my phone or the money. I was at the casino but i lost money ,I did not cash anything out. Should i recant my statement ?

What state? Did you say that you won the 5K on the same day as the robbery?

You made a false statement to the police. That could potentially result in you facing charges for the false report (though it is not perjury). You might also face civil liability for it, too. It is not clear what the lie was: were you not robbed at all and lied about everything or were you in fact robbed but lied about the amount? Either way, why the lie? What did you hope to achieve by it? It's now time for you to go to a criminal lawyer to figure out what to do to minimize the potential impact of what you've done.

It was not your smartest move to lie to the police about what was stolen. You can recant your statement about the money by saying you were mistaken about what you had in your wallet at the time of the theft and the police can correct their report.

If you in fact had a cell phone and wallet stolen, you are unlikely to ever see them again but, if the thief is apprehended, the court can order restitution. You can be compensated for your actual losses.

You should not be charged with lying to the police if you do not persist with your lie.

Contacting an attorney in your area for advice prior to speaking to the police or filing a claim with your insurer (if the loss is worth a claim) is wise and advised.

Now, if a suspect is identified and charged, the defense may allege that there was no money in an effort to minimize the penalties or paint you as a liar. If it goes to court, THEN you may be held liable for perjury if you maintain the phony claim. Until then, you appear to be guilty of making a false report to the police. But, the odds of the police trying to verify what was stolen is about nil.

I have a question, though. You say you were "robbed" ... does this mean someone held you up at gunpoint or through threats of violence? Or, was the backpack and such stolen from your car by an unknown perpetrator?

Eh ... missed the first sentence somehow ... need more coffee. I see so many people using the term "robbed" when they mean something else that it's a reflex to ask.
An acquaintance of mine was on a Detroit campus late at night and he was approached by a man with a gun who demanded cash. The fellow I know only had about $1 on him and no credit cards. The would-be thief said it wasn't enough and he walked off. My acquaintance said it was the first time he ever felt lucky to be poor. :)

At the university where I work, there was an armed robbery of 5 students in a parking lot a few weeks ago. They nabbed phones, wallets, and a purse from the only girl. One of the kids had a cheap knock-off phone and the robber threw it back at him telling him he could keep his "cheap shit."

The irony there was that only the girl fought their attackers - over her purse! She got punched and not shot, thankfully.

I live in South Africa. The amount is 5000 ZAR which is equivalent to 355 USD. The full scenario of my statement is as follows to the police.

I went to the casino , won a few chips ( about 8000 ZAR, but lost it to about 6500 ZAR and cashed it ) , I took a photo of the chips I had won and cashed it out thereafer. This was several days earlier, but I did come back and have that amount in cash with me in the car the day I was robbed.

Earlier the day I was robbed I was at the casino , but did not win , but went to my car several times to collect cash which I stored inside the car.In my statement I said that I had won it the day I was robbed, but in fact I won it a few days earlier, and it can be confirmed by the casino. There is photo evidence of the chips I won before I cashed it out at the casino, which I sent to a friend on my whatsapp. There should also be footage of me entering and leaving the casino several times going back to my car collecting cash each time(I had a few thousand in notes in my car so that I dont spend it all at once), the day I was robbe. Even if it is possible , the CCTV cameras could catch a glimpse of what was inside the car inside the casino parking lot and a few notes might be spotted.The total amount of cash that was inside the car could not be determined , but I disclosed the amount at 5000. My iphone 7, which new could be valued at 13000 ZAR which can be confirmed by the CCTV cameras inside the casino , was also stolen.The exact amount of cash inside my wallet could be more than 5000 or less but it was around that amount.

I stopped at a Traffic light and a black GTI stopped next to me, 2 men jumped out (one from the passenger seat and one from the back seat).The person in the passenger seat had a gun and held it against my window.I was scared shitless and I really wet myself because of the shock.I opened the car doors because I knew he would shoot me if I tried to resist.The person who jumped out of the backseat grabbed everything he ought to be valuable(backpack, wallet and Iphone)All of this took place in a matter of seconds and I was left completely shell shocked thereafter.I couldn't catch a glimpse of the number plates or the details of their faces.
