Cited for Unsafe Passing When Actual Violation Was Jaywalking

I was stopped for a jaywalking violation, but when I received the citation in the mail the offense was listed as "unsafe passing on right shoulder". This appears to be a clerical error. The CVC section codes are very similar. The citation includes my license number, but the vehicle license number field is blank.

In responding to the citation with a written declaration, for evidence I am indicating the absence of a vehicle license number on the citation, and in the statement of facts I state the following: "I do not own a motor vehicle, and I was not driving a motor vehicle on the date in question. I declare under penalty of perjury that this statement is true and correct." I did not say anything else in my declaration.

Do you think this will lead to a verdict of not guilty?
