What is the name of your state? Utah On Nov 15th, 2018 I was asked by 2 WVC police officers to step outside of my home to answer a few questions about the mattresses I had stacked in my driveway. Assuming they were going to tell me that some neighbors had complained or that I needed to have them moved. Instead they asked where I got the mattresses and informed me that they were stolen (fiancé had came outside by now) and therefore we were in possession of stolen property. The officers ran our DL’s soon to find out I had a few warrants (minor infractions) and that my fiancé was on parole. Immediately their demeanors changed and all further questions about how we got them were directly asked to him. They explained we were waiting for Salt Lake PD to arrive to finish the investigation and that they were only asked to keep the peace until then. My fiancé and I, now trying to find the KSL add and proof that we had bought them from a former furniture business owner on KSL.. one of the WVC officers then got a call stating Salt Lake was not coming down to finish the investigation claiming there was no point since they could not identify the suspect.. officer quickly approached my fiancé and asked him to turn around with his hands behind his back and he was taken into custody. I believe they arrested him being that he was on parole when in fact I was the one who inquired about the mattresses and set the whole transaction up with the KSL seller. My fiancé was only there to help me load the mattresses since I am 26 weeks pregnant. What do you suggest we do at this point?

I suggest you and your fiancé get attorneys if charged with a crime or crimes. Say nothing more to the police.

I suggest you say nothing further to the police and get an initial consult with a lawyer.

*Of course* the reason your fiancé was arrested was because of he was on parole. As they believed that the mattresses were stolen, they concluded that either he stole them or is associating with thieves - parole violations.

You may still be arrested. They don't have to arrest everyone at once.

So get your documentation together and get that initial consult with a lawyer.

If you had warrants you should have been arrested too. That still may happen.

Is your boyfriend back home yet or is he still in jail?

I have to ask... why are you buying/selling used mattresses? :eek:

He is now at the prison. He’s been able to call once which was 3 days ago.. not exactly sure what’s going on.

I can’t say I’ve ever seen somebody held for a parole violation hearing returned to prison. Normally they get tossed into the local jail and wait for a violation hearing.

No. After he was arrested and taken to the county jail he had a 3-day AP&P hold on him (weekends not included) so after a total of 5 days it then showed released on own recognizance for the “theft by receiving stolen property” and sentenced for the “violation of parole” we thought he was being released instead he now had a 7 day board of pardons hold on him.. they issued a warrant for his arrest and he was transferred to the state prison.

Can they restrict a person to only be able to call once a week? This is insane. I’m 5 months pregnant and also have his 2 kids and he gets to call one time?

One reason your fiancé was probably returned to prison after being released on Adult Probation and Parole (AP&P) supervision is that he violated a standard condition of parole ("will not associate with any person who is involved in criminal activity").

You were involved in criminal activity with the purchase of stolen goods but, even if charges are never filed against you over the mattresses, you still have some outstanding warrants to take care of.

It is common for jails and prisons to restrict a prisoner's outside contact with those who have committed crimes.

I think right now you need to concentrate on your pregnancy and make sure as much as you can that you give birth to a healthy baby - and hire an attorney to help you with your criminal issues (past and present).

Your fiancé will have to deal with his parole violation without your support. He should try to consult with an attorney before his Board hearing.

I have 2 minor infraction warrants ( not signaling for more than 2 seconds and no insurance) and how can they say he was associated with someone involved in criminal activity when we had absolutely no knowledge of the mattresses being stolen until later informed by the police. I’ve got the emails/evidence of proof that we bought them from someone online. If we were able to show that to the officers when they came to our house they said he wouldn’t have been arrested. But unfortunately we didn’t know the password to log into the account from his phone and my phone was dead. That being said if he goes to court and they can’t prove that he had knowledge or thoughts that the mattresses were stolen and with the evidence that we have.. let’s say the charge gets dropped case dismissed.. does he still get a violation of parole even though he was found not guilty?
